Terms and conditions of use

The use of this site is governed by the policies, terms and conditions set forth below. Please read them carefully. Your use of this site, your placement of an order, and/or your submittal of any purchase order to Sckr Pnch indicates your acceptance of these terms and conditions. These terms and conditions shall supercede any subsequent terms or conditions included with any purchase order, whether or not such terms or conditions are signed by Sckr Pnch. Sckr Pnch reserves the right to make changes to this site and these terms and conditions at any time.

Your details

When you register with the Sckr Pnch website, you will be required to choose a contact email address and password. You are responsible for all sessions and transactions taken under these details.

If any of your details change, you must inform Sckr Pnch as soon as possible. You may update your details by signing into your account and updating your online wallet.

The contract between us

Sckr Pnch must receive payment of the whole of the price for the goods that you order before your order can be accepted, and the contract formed. Payment is taken at the point of order. Once payment has been received Sckr Pnch will confirm that your order has been received by sending an email to you at the email address you provide. The order confirmation email will include your name, the order number and the total price. Sckr Pnch acceptance of your order brings into existence a legally binding contract between us on these terms. Any term sought to be imposed by you in your order will not form part of the contract.

Sckr Pnch is entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the goods appearing on our website. If any error or inaccuracy is discovered with regards to the advertised price of the goods that you have ordered, we will contact you as soon as possible by email. This will be to inform you of the correct price of the goods, and to ask you if you wish to continue with the order at the amended price, or to cancel the order altogether.

Sckr Pnch reserves the right, in its sole discretion, to make any necessary updates, modifications and adjustments at any time without prior notice to product descriptions, warranties and prices, due to errors, product discontinuation, changing costs, new market conditions or any other factor. All prices are subject to all applicable sales taxes, handling charges, shipping charges and currency exchange rates.

Your receipt of an electronic or other form of order confirmation does not signify Sckr Pnch acceptance of your order, nor does it constitute confirmation of our offer to sell. Sckr Pnch reserves the right at any time after receipt of your order to accept or decline your order for any reason.

By using this website, you represent and warrant that you are at least 18 years of age. You agree that you are financially responsible for all of your use of this website (as well as for use of your account or log-in information by others, including without limitation minors living with you). You shall be completely responsible for all charges, fees, duties, taxes and assessments arising out of the use of this website. You agree to comply with all applicable laws, rules and regulations. You agree and represent that you are buying for your own use only, and not for resale. Sckr Pnch in their sole discretion reserves the right to review and refuse fundraising affiliates.

Withdrawal by you from the contract

If you are an individual and are not buying goods on behalf of a business, there are certain circumstances in which you may withdraw from the contract and these are set out here.

You may withdraw your order for goods at any time up to the end of the fourteenth working day after you have received the goods. You do not need to give Sckr Pnch any reason for withdrawing your order.

To withdraw your order you must notify Sckr Pnch in writing at the Sckr Pnch address.

If you have received the goods before you withdraw your order, then you must send them back to the Sckr Pnch return address at your own cost and risk, unless the goods were supllied faulty or damaged. If you withdraw your order but Sckr Pnch has already processed the goods for delivery and you have received them, you must not unpack the goods when they are received by you and you must send the goods back to Sckr Pnch at your own cost and risk as soon as possible.

Once you have notified Sckr Pnch that you are withdrawing your order, any sum debited to Sckr Pnch from your credit card or account will be re-credited to your account as soon as possible and in any event within 30 days of your order. Payment systems such as PayPal or Moneybookers might not refund the whole amount, but keep a transaction fee.

Availability of goods you order

If Sckr Pnch has insufficient stock to deliver the goods ordered by you, we will notify you asap by email at the address given by you in your order form. The refund will be made as soon as possible and in any event within 30 days of your order. Sckr Pnch will not be obliged to offer any additional compensation for disappointment suffered.

Liability

If the goods Sckr Pnch delivers are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, Sckr Pnch shall have no liability to you unless you notify Sckr Pnch in writing at the Sckr Pnch contact address of the problem within ten working days of the delivery of goods in question.

If you do not receive goods ordered by you within 30 days of the date on which they were dispatched to you, Sckr Pnch shall have no liability to you unless you notify Sckr Pnch in writing at the Sckr Pnch contact address of the problem within 40 days of the date on which the goods were dispatched to you.

Sckr Pnch will not be liable to you for any indirect or consequential loss or damage arising out of any problem you notify to Sckr Pnch under this condition and Sckr Pnch shall have no liability to pay any money to you by way of  compensation.

Force Majeure

Sckr Pnch shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable controle.

Governing Law

The contract between us shall be governed by and interpreted in accordance with Belgian law, and the Belgian courts shall have jurisdiction to resolve any disputes between us.

You should be aware that the Information may contain errors, omissions, inaccuracies, or outdated information. Sckr Pnch makes no representations or warranties as to the completeness, accuracy, adequacy, currency, or reliability of any Information and shall not be liable for any lack of the foregoing. Descriptions of, or references to, third party products or publications do not imply endorsement of that product or publication. We are not engaged in rendering legal, accounting, or other similar advice or professional services. Typographical Errors

In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, Sckr Pnch shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. Sckr Pnch shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit/debit card charged. If your credit/debit card has already been charged for the purchase and your order is canceled, Sckr Pnch shall immediately issue a credit to your credit/debit card account in the amount of the charge.
